Workers Compensation

If you’ve suffered a serious injury at work, you already have a lot to worry about. On top of the added stress of dealing with your recovery, you are probably struggling to make ends meet while out of work. You may be overwhelmed with a slew of medical bills, and the insurance companies don’t make the process any easier. At Loughran & Corbett, our team understands exactly what you are going through, and we’re here to take the weight off your shoulders.

Attorney Loughran has filed his appearance in almost 3000 cases at the Department of Industrial Accidents and has practiced before the DIA for over 40 years. He has negotiated millions in workers compensation settlements, tried numerous cases for the DIA and with Social Security and secured Accidental Disability Retirements for municipal employees throughout the Commonwealth.

There is no legal fee paid unless you win, and a lump sum settlement is paid. All fees are regulated by statute and require approval of an Administrative Judge. Legal fees are frequently paid by the insurer pursuant to the Workers’ Compensation statute while your case is in litigation. We will never send you a bill for your Workers’ Compensation case.

We can help you through every step of the case, from start to finish.

When it comes to steering through workers’ compensation law, having Loughran & Corbett on your side will make a big difference. We have represented countless injured workers before the Department of Industrial Accidents and have litigated cases all the way up to the Supreme Judicial Court of Massachusetts. With over fifty years of practice, we have gained the reputation of being strong negotiators and fierce advocates for our clients. We know that timely action and the right information can make all the difference. We specialize in understanding the ins and outs of the system, ensuring you get the benefits you’re entitled to.

Your rights are statutory and include the following:

  1. Medical Benefits: Workers’ compensation covers the cost of medical treatment for work-related injuries or illnesses. This includes doctor visits, hospital stays, surgeries, medication, and rehabilitation services, mileage reimbursement, and reimbursement for out-of-pocket expenses.
  2. Income Replacement: If you are unable to work due to a work-related injury or illness, workers’ compensation provides wage replacement benefits, typically 60% of your preinjury average weekly wage for total disability. You benefits are reduced if you are partially disabled.
  3. Permanent and Total Disability Benefits: Workers’ compensation provides for permanent and total disability benefits, when applicable.
  4. Vocational Rehabilitation Services: If your injury requires vocational rehabilitation to help you return to work or find a new job, workers’ compensation often covers these services.
  5. Death Benefits: In the unfortunate event of a worker’s death due to a job-related incident, workers’ compensation provides death benefits to the surviving dependents, such as spouses and children. This typically includes funeral expenses and financial support.
  6. Legal Protection: Workers’ compensation is a no-fault system, meaning you don’t have to prove that your employer was negligent to receive benefits. As long as your injury was arising out of and in the course of your employment, your injury is covered.
